In this interlocutory appeal under C.A.R. 4.1, the People challenge an order of the district court suppressing (1) evidence seized pursuant to a search warrant and (2) a statement made by a juvenile while in police custody. The district court held that drugs found in the juveniles purse must be suppressed because the search warrant that allowed officers to search the apartment did not cover the personal property of the juvenile who was not a resident of the apartment and was not named in the warrant or the accompanying affidavits. In addition, the district court suppressed a statement which was made by the juvenile while she was in custody because the juvenile was not advised of her rights under Miranda v. Arizona, 384 U.S. 436, 16 L. Ed. 2d 694, 86 S. Ct. 1602 (1966), and because she was interrogated without the presence of a "parent, guardian, or legal or physical custodian," in violation of section 19-2-210, 8B C.R.S. (1996 Supp.).
